Terms of Service

1. Introduction

Welcome to Dotty Widget. These Terms of Service (“Terms”) govern your access to and use of the Dotty Widget mobile application, websites, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and Dotty Widget, its affiliates, and subsidiaries. They also explain the rules for your participation, the rights and responsibilities of all parties, and the limitations of liability.

2. Use of the Service

The Service allows users to interact with friends, share content, and use widgets and social features. You agree to use the Service only for lawful purposes and in accordance with these Terms.

You specifically agree that you will not:

• Use the Service in violation of any applicable law, regulation, or third-party right.
• Attempt to gain unauthorized access to other users’ accounts, the Service infrastructure, or systems associated with the Service.
• Upload, transmit, or distribute content that is unlawful, abusive, harmful, defamatory, obscene, or otherwise objectionable.
• Engage in actions that interfere with the proper operation, security, or integrity of the Service.

Violation of these rules may result in suspension or permanent termination of your account, at our sole discretion.

3. User Accounts

Certain features require creation of a user account. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity under your account, whether authorized or not.
• Providing accurate, current, and complete information during registration and thereafter.

If you suspect unauthorized access to your account, you must notify us immediately. Dotty Widget is not liable for any loss or damage resulting from unauthorized access if you fail to secure your account.

4. User Content

You may submit content, including photos, avatars, text, and other media (“User Content”). By submitting User Content, you grant Dotty Widget a limited, non-exclusive, worldwide, royalty-free license to store, process, and display such content solely for operating, maintaining, and improving the Service.

You represent and warrant that:

• You own all rights in the User Content, or have obtained necessary permissions from the rightful owner(s).
• Your User Content does not infringe any intellectual property rights, privacy rights, or other legal rights of any third party.
• Your User Content complies with all applicable laws and regulations.

Dotty Widget reserves the right, at its sole discretion, to remove or restrict access to User Content that violates these Terms or is otherwise objectionable.

5. Privacy

Your use of the Service is also governed by our Privacy Policy. The Privacy Policy explains how we collect, use, store, and protect your Personal Data.

6. Location and Device Features

Some features of the Service may require access to your device’s capabilities, including location services, camera, photo library, and notifications. Such permissions are requested solely to enable specific functionality within the App.

You may disable permissions through your device settings; however, certain features may not function properly if permissions are denied.

7. Service Availability and Modifications

We strive to provide a reliable Service but do not guarantee uninterrupted access. We may:

• Modify, suspend, or discontinue features of the Service temporarily or permanently.
• Perform scheduled or emergency maintenance, which may temporarily disrupt access.
• Update or upgrade the Service to improve security, functionality, or compliance.

TopKet Widget will not be liable for any loss, damage, or inconvenience resulting from Service interruptions or modifications.

8. Intellectual Property

All intellectual property rights, including software, designs, logos, trademarks, content, and branding, remain the exclusive property of Dotty Widget and its licensors.

You may not:

• Copy, reproduce, or modify any part of the Service.
• Reverse engineer, decompile, or attempt to derive source code or algorithms.
• Sell, resell, or distribute the Service or any part thereof without explicit written consent.

9. Termination

We may suspend or terminate your access to the Service, at our sole discretion, if you violate these Terms, engage in unlawful activity, or pose a risk to other users or the Service itself. You may terminate your account at any time by discontinuing use of the Service.

10. Limitation of Liability

To the maximum extent permitted by law, Dotty Widget shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of data, content, or service interruptions.
• Actions, errors, or omissions of third-party service providers.
• Damages arising from unauthorized access to or use of your account.

Your use of the Service is at your own risk, and you acknowledge that you assume full responsibility for any resulting harm or loss.

11. Indemnification

You agree to indemnify, defend, and hold harmless Dotty Widget, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, costs, or expenses arising out of:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any applicable law or third-party rights.
• Claims related to your User Content.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Dotty Widget is incorporated, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or your use of the Service shall be resolved through good-faith negotiations, or, if necessary, through binding arbitration in accordance with local regulations.

13. Changes to These Terms

Dotty Widget may update these Terms from time to time. If material changes occur, we will notify users through the App or other reasonable channels. Continued use of the Service after updates constitutes acceptance of the revised Terms.

14. Miscellaneous

• If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• Headings are for convenience only and do not affect interpretation.
• Failure to enforce any right or provision does not constitute a waiver of that right.

15.Subscriptions (Apple)

Some features of Dotty Widget are offered as auto-renewable subscriptions.
- Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel your subscriptions by going to your account settings on the App Store.
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
